No repetimos aquí esas reglas.

Modificaciones, ley aplicable e idioma

Website terms of use

Last updated: 19 October 2026 · Version 1.0

How poyntia.com is used beyond what the Legal notice says: what happens to your feedback, when we may suspend access and what limits of liability apply, with notices for consumers and for users in the United States.

At a glance

What they cover

The use of poyntia.com

These terms complement the Legal notice. The services you contract with us are governed by your agreement, not by this page.

What you may do

Browse the site and evaluate us

The licence to use the site, the prohibited uses and the reservation of text and data mining rights are in the Legal notice. This page adds what is missing.

What you send us

Your feedback, with limits

We may use the suggestions you send us, with no obligation or compensation. Please do not send confidential information that way.

Liability

Informational and capped

The site is provided as is. Liability is capped between businesses, and nothing here cuts back the rights the law gives consumers.

How the documents fit together. The Legal notice and terms of use identifies the owner and governs intellectual property, prohibited uses, the exclusion of warranties, the governing law and the courts. The Privacy policy and the Cookie policy govern your data. This page adds the rest and, if any rule conflicted with the Legal notice, the Legal notice prevails.

Relationship with the Legal notice and with your agreement

These terms govern access to and use of poyntia.com (the “Website”), which is owned by POYNTIA, S.L. (“Poyntia”, “we”). They are read together with the Legal notice and terms of use, which remains in force on everything it covers: identification of the owner, intellectual and industrial property, the limited licence to use the Website, prohibited uses (including bulk scraping and the use of content to train artificial intelligence models), the reservation of text and data mining rights, third-party content, links, availability, the governing law and the courts. We do not repeat those rules here.

These terms do not govern Poyntia’s platform or services. If you are a customer, the service you contract is governed by the agreement you sign, which prevails over these terms on everything relating to that service. When we process personal data on behalf of a customer, the data processing agreement also applies.

By accessing or using the Website you state that you have read and accept these terms and the Legal notice. If you do not agree, do not use it. The Website is aimed at businesses and professionals.

Feedback and suggestions

You may write to us with ideas, comments or suggestions about the Website or our services (for example, at info@poyntia.com). If you do, you grant POYNTIA, S.L. a worldwide, royalty-free, non-exclusive, perpetual and transferable licence to use, reproduce, modify and exploit that feedback without restriction and without any obligation to compensate you, to credit you or to keep it confidential.

This licence does not affect the moral rights that the law gives authors as inalienable rights (Article 14 of the consolidated Intellectual Property Act), or your personal data, which we process in accordance with the Privacy policy. Please do not send confidential information or your company’s trade secrets that way: if you wish to share them, ask us for a confidentiality agreement first.

Third-party software and services

Some components of the Website may be offered under open-source or third-party licences. For those components, their own licences apply and may prevail over these terms. Links to third-party sites and the official sources cited on the Website are governed by the Legal notice.

Monitoring and security

Poyntia does not host user-submitted content on the Website and has no obligation to monitor what you send us. We may take technical measures to protect the security of the Website, for example filtering abusive traffic through our network provider, which processes technical connection data for that purpose, as explained in the Privacy policy. We may also retain and disclose information where a law or a competent authority requires it.

Term, suspension and termination

You may stop using the Website at any time. Poyntia may suspend or block your access, without prior notice, if you breach these terms or the Legal notice, if there are reasonable signs of abusive or unlawful use, or for security or maintenance reasons.

When access ends, the licence to use the Website ends. Provisions that by their nature should survive remain in force: intellectual property, feedback, indemnity, limitation of liability and the governing law.

Indemnity between businesses

If you use the Website in the course of your business or profession, you agree to hold Poyntia harmless against the claims, damages and reasonable expenses (including attorneys’ and court-representative fees) that a third party brings against it as a result of your unlawful use of the Website or your breach of these terms, unless the damage is due to Poyntia’s wilful misconduct or fault. Poyntia will notify you of the claim without delay and allow you to take part in its defence.

This clause does not apply to consumers (see the section “Consumers”).

Warranties and limitation of liability

The Website is provided “as is” and “as available”, for informational and commercial purposes. To the maximum extent permitted by law, Poyntia gives no warranty of any kind, express or implied (including those of merchantability, fitness for a particular purpose and non-infringement), and does not warrant that the Website will be available, error-free or free of malicious code. The section “Exclusion of warranties and liability” of the Legal notice also applies.

To the maximum extent permitted by law, and except in case of wilful misconduct or gross negligence, Poyntia’s total liability to you for all claims arising out of access to or use of the Website will not exceed one hundred euros (€100). Poyntia is not liable for indirect damages, lost profits, or the loss of data or opportunities arising from access to or use of the Website.

These limits do not apply to consumers or to any liability that the law does not allow to be excluded or limited.

Consumers

The Website is aimed at businesses and professionals. If, nevertheless, you access it as a consumer within the meaning of the consolidated General Act for the Protection of Consumers and Users (Royal Legislative Decree 1/2007), nothing in these terms limits the rights that Act gives you as inalienable rights. Clauses that would be unfair to a consumer under Articles 82 and following of that Act will not be enforceable against you, and the jurisdiction that the law gives you will be respected.

Users in the United States

The Website is aimed at businesses and professionals, not at minors. If you live in California or in another US state with a privacy law, your rights are described in the section “Information for residents of the United States” of the Privacy policy.

The Website is provided “as is” and “as available”, without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, Poyntia will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of access to or use of the Website, and its total liability will not exceed the amount stated in the section “Warranties and limitation of liability”.

Some jurisdictions do not allow certain warranties to be excluded or certain damages to be limited. In that case, the exclusions and limits in these terms apply to the maximum extent that jurisdiction permits. These terms are governed by Spanish law and by the courts named in the Legal notice. If you access the Website from outside Spain, you are responsible for complying with any local law that applies to you.

Changes, governing law and language

We may change these terms. The current version is the one published on this page, with its date and number; for changes and for the governing law, the courts, severability and language, the Legal notice applies (sections “Changes”, “Governing law and jurisdiction” and “Language”). These terms are published in Spanish and English; if the two versions differ, the Spanish one prevails.
